Dealing with Car Insurance Companies that Blame the Accident on You

Your car insurance may have the best offerings, but if it rejects your claim, everything would be for nothing.  Forget your monthly premiums or maybe even the fact that the accident was not your fault.  Some car insurance companies are out to find faults in claims in order to escape paying for the damages.  So what should you do when all of a sudden the company that promised to serve you not only turns its back on you, but goes against you completely?  There are some points that you should always remember.

Go over the copy of your insurance policy.

If you have to fight for your right, you should at least get all your facts straight.  Have you actually read all the fine print?  If not, you may be fighting a battle that has already been lost and affirmed by your own signature.  Are there sections about the relationship between blame and evidence?  Maybe your car insurance just wants more proof that you are not to blame for the accident   One thing is almost one hundred percent sure: your policy may not pay for the damages if it turns out that you are the one to blame for the accident. However, your car insurance company will be paying for the other vehicle’s damages.  At the least, *you would have a third party car insurance.  This means that the insurance pays for all your liabilities, but does not pay for your personal damages.

Present police report and gather other evidence to support claims.

As with any other types of claims, you should have evidence to support you.  If you have a camera with you, photograph several angles of the accident.  If the accident is a collision, you need to exchange contact information with the other driver.  Some drivers an admission of guilt if they were to blame for the accident, but this is not always advisable, for some companies would rather investigate on their own.  Immediately report the accident to the police.  It may be tempting to settle privately, but it would be to your own good if the police are involved.  Submit your personal evidence and a copy of the police report to your car insurance.  If the car insurance company wants to investigate the scene themselves, accompany the representative so that you can point out angles that they have not examined.  It is also good to know how the company is assessing the damage.

File a letter of complaint.

If you are still having trouble with your car insurance company, you can write a complaint letter.  By this time, you have already familiarized yourself with your policy coverage.  You are also sure that you are not to blame for the accident.  So with clear conscience and strong evidence to support it, write a detailed complaint letter that also cites the exact lines from the policy that you will be needing to get your claim.  Attach a copy of the police report so that your insurance company can easily refer to it.

To make sure you get claims from your insurance, you should not only know your policy inside out, you must also present strong evidence that could no longer be denied.
