Dealing with Money Issues in Divorce Settlement

Share

Divorce does so much more than just sever the marital ties between a married couple.  It shatters a family emotionally, mentally, and financially.  In these times, it’s even harder to settle divorces and not worry about the finances.  One will have to mind the alimony to think about, child support, and even the bills to pay during and after the
divorce proceedings.

Does a prenup really solve money issues in divorce settlements?

A prenup can help determine to whom certain properties and assets will be reverted to in the event of a divorce or separation.  However, these agreements can be overturned in special cases such as when a child is born, when the terms are unfair to one of the parties, or when one of the parties signed under duress.

Dealing with money issues in divorce settlement

There are many ways in which to settle monetary differences in a divorce proceeding.

Follow the prenup

If you had a prenuptial agreement, this can serve as a basis for a fair distribution of properties and assets.  However, if it becomes unfair for one party, the prenup can be overturned and a new and more fair ruling can be decided upon.

Take note of responsibilities such as child care, education, and living allowance

Who gets custody of the kids?  Who’s more financially stable?  These questions should be asked when a couple, especially those with kids, should take care of.

Sort out your bills

While in the process of divorce, separate the bills that used to be jointly sent to you.  Make sure to change the names for the utilities or even magazine subscriptions.

Look for a source of income

For those who have been unemployed or just had a small income during the marriage, a divorce packs in a mean punch especially in the financial aspect.  Find ways to support yourself and your children.

If ever the prenup doesn’t provide you with much money to start over or support the kids, you can always appeal for reconsideration.  A divorce settlement doesn’t need to become a dirty process.  As long as you both have lawyers and maintain cool heads during the process, you both can get the chance to start over with your own lives.
